Developer Xreal received a cease and desist letter from ZeniMax, sent on behalf of the videogame publisher Bethesda. The letter was sent in regards to Xreal’s upcoming app Fortress Fallout, a competitive tower building game on mobile. Bethesda claims the game’s title infringes on the trademark they have on the word ‘Fallout’, used in their popular post-apocalyptic science fiction role-playing series of the same name.
Bethesda have tried to exert their influence over other developers before in 2012 when they had a dispute with Minecraft publisher Mojang. Mojang’s tactical card game Scrolls, that we wrote about here when it was released last December, upset Bethesda due to its similarities to another of their popular RPG series The Elder Scrolls. The two developers managed to reach a settlement with Mojang retaining the title.
Jordan Maron from Xreal spoke about the incident on his CaptainSparkles YouTube account, saying he had been advised to change Fortress Fallout‘s name as they don’t have the resources for a lengthy legal battle. Jordan went on to ask viewers to leave their suggestion for a new name in the comments. You can check it out below.
